GENERAL TERMS AND CONDITIONS

  1. Subject of the Agreement
    • Heritage Roll Kft. (hereinafter: Service Provider) rents out, and the person placing the current order (hereinafter: User) rents, the electric scooter specified in the order declaration attached to this GTC (hereinafter: Scooter), as well as the helmet belonging to it, for the period specified in the declaration.
    • On the day of rental, the Service Provider organizes a sightseeing tour (hereinafter: Tour) lasting 1.5 hours in the Buda Castle District for the User with the Scooter.
    • The Service Provider ensures that at the end of the Tour, the User may consume one drink from the designated options at the Savoy Terrace (1014 Budapest, Szent György tér 2.) hospitality venue at the expense of the Service Provider.
  2. Rules Regarding the Scooter
    • The Service Provider guarantees that during the rental period, the Scooter is technically suitable for proper use and that no third party has any rights over the Scooter that would restrict its use.
    • The Service Provider declares that the Scooter is covered by liability insurance.
    • The User may use the Scooter exclusively alone and solely for participation in the Tour; any other activities (e.g.: using the Scooter outside the Tour route; allowing another person to use the Scooter under any title; using the Scooter by more than one person at the same time; racing with the Scooter) are not permitted.
    • In case of malfunction, the Service Provider will immediately replace the Scooter regardless of the cause of the malfunction; the Tour is suspended for the duration of the replacement.
    • The User acknowledges that the Scooter may only be used in accordance with applicable road traffic laws, meaning, for example, only at permitted speeds, only on permitted roads, not on sidewalks, and may only be parked in permitted locations.
    • The User acknowledges that wearing the helmet during the use of the Scooter is mandatory and must not be interrupted.
    • The User acknowledges that the maximum speed of the Scooter can be remotely limited by the Service Provider, and this maximum speed may also change during the Tour.

  3. Rules Regarding the Tour and the Subsequent Drink
    • The User is required to appear at the location and time specified in the order confirmation and to present the voucher (in paper or electronic form) included in the confirmation.
    • The Service Provider provides English-language assistance (an English-speaking tour guide) during the Tour.
    • The maximum number of participants in the sightseeing tour — not including the tour guide — is 10 people. If the order includes more than 10 people, not all Users listed in the order can participate in a single Tour; they will be divided into two or more Tours.
    • The User acknowledges that if the sightseeing tour cannot be held on the originally planned route due to reasons beyond the Service Provider’s control, the Service Provider is entitled to change the route of the Tour.
    • The drink at the end of the Tour can only be ordered after the Scooter has been returned to the Service Provider.
    • The Service Provider does not guarantee that a table will be available for the User at the hospitality venue; however, this does not affect the Service Provider’s obligation to provide the drink.

  4. Rules Regarding the User
    • The User declares that they will only start using the Scooter after participating in a training session held by the Service Provider presenting the technical features and operation of the Scooter, and after having verified that the Scooter is in proper technical condition.
    • The User declares that they are at least 14 years old at the start of using the Scooter.
    • The User acknowledges that they may not use the Scooter or participate in the Tour while intoxicated or under the influence of drugs.
    • The User declares that they will be reachable by the Service Provider at the phone number provided in the declaration throughout the entire rental period. The Service Provider will delete the phone number and other personal data following the end of the rental period in accordance with data protection regulations.
    • The User is obliged to use, handle, and preserve the Scooter with the general care expected. The User acknowledges that they are fully responsible for any direct or indirect damage resulting from their negligent conduct.
    • The User assumes full responsibility for any infractions committed with the Scooter during the rental period (e.g.: improper road usage, illegal parking, speeding) and acknowledges that the Service Provider will immediately report to the authorities in case of a suspected criminal offense (e.g.: theft of the Scooter by the User).
    • The User is obliged to immediately inform the tour guide, or the Service Provider if the guide is unavailable, of any extraordinary events (e.g.: accident; theft or damage of the Scooter).

  5. Cancellation Conditions
    • The User is not entitled to a refund of the rental fee paid at the time of order if the rental is canceled within 24 hours prior to the start of the rental, regardless of the reason for cancellation.
    • If the sightseeing tour cannot be held due to extreme weather conditions, the User is not entitled to a refund of the rental fee paid at the time of order.

  6. Other Provisions
    • If the Service Provider does not exercise any of its rights provided by this GTC or by law, this shall not be considered a waiver of such rights.
    • The invalidity of any provision of this GTC does not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that most closely reflects the meaning and purpose of the invalid provision or the other provisions of the GTC.
    • In matters not regulated in this GTC, the laws of Hungary — in particular the rules of the Civil Code applicable to lease agreements — shall apply.
    • This GTC is available in both Hungarian and English. In case of discrepancy, the Hungarian version shall prevail.
